1. Overview
These Beat Licensing & Digital Product Terms apply to beats, instrumentals, albums and other digital music products offered by Globe King Records under the Globe Made It brand.
They supplement the Globe King Records Terms & Conditions.
By purchasing or otherwise obtaining a digital music product, you agree to comply with the rights and restrictions applicable to that product.
The rights granted to you depend on the specific product and license purchased.
2. Purchasing a Beat Does Not Mean Buying the Copyright
Unless a separate written agreement expressly states otherwise, purchasing or downloading a beat does
not transfer ownership of the copyright in the beat.
Globe King Records retains ownership of the copyright and other rights it owns in the beat, subject to any rights belonging to third parties.
The purchase gives you only the limited rights expressly granted under the applicable product terms.
Canadian copyright law generally distinguishes between a
licence, which permits specified uses while ownership remains with the copyright owner, and an
assignment, which transfers some or all copyright rights.
3. Basic Beat Purchase
Unless the product page expressly states otherwise, a basic beat purchase is intended for:
- personal listening;
- personal creative projects;
- non-commercial music creation; and
- non-commercial use on platforms such as YouTube or social media.
A basic purchase does
not automatically grant commercial rights.
The purchaser may not assume that payment for a beat provides unlimited rights to exploit, distribute, monetize, sublicense or commercially exploit the beat.
4. What a Basic Purchase Does Not Permit
Unless expressly authorized in writing, a basic beat purchase does not permit you to:
- sell the beat itself;
- redistribute the beat;
- upload the standalone beat to another marketplace;
- offer the beat for download by third parties;
- claim ownership of the beat;
- register the beat itself as your original composition;
- create or sell a sample pack containing the beat;
- extract loops, stems or samples from the beat for separate distribution;
- sublicense the beat;
- transfer your purchased rights to another person or company;
- use the beat in paid advertising;
- use the beat in a commercial podcast;
- use the beat in a commercial game or application;
- use the beat as music for a commercial website;
- use the beat in a commercial film, television production or other audiovisual production;
- monetize content containing the beat where monetization requires commercial music rights;
- distribute a finished recording containing the beat through commercial music-distribution services where the applicable license does not permit such distribution; or
- otherwise commercially exploit the beat beyond the rights expressly granted.
5. YouTube and Social Media
A basic purchase may allow the purchaser to use the beat in a
non-commercial creative video or social-media project, subject to the applicable product terms.
This does not automatically authorize:
- monetization;
- paid advertising;
- sponsored commercial campaigns;
- brand promotions;
- commercial client work; or
- other commercial exploitation.
If your intended use is commercial, obtain the appropriate commercial license before using the beat for that purpose.
6. Streaming Platforms and Music Distribution
Unless expressly authorized by the applicable license, a basic beat purchase does not grant the right to distribute a recording containing the beat through commercial music-distribution platforms such as:
- Spotify;
- Apple Music;
- Amazon Music;
- YouTube Music;
- Deezer;
- Tidal; or
- similar services.
A commercial or other appropriate license may provide those rights.
The exact permitted distribution channels will depend on the written license applicable to the purchase.
7. Monetization
A basic purchase does not automatically authorize monetization of content containing the beat.
Commercial monetization may include:
- monetized videos;
- advertising revenue;
- sponsored content;
- paid promotions;
- commercial websites;
- commercial podcasts;
- client projects;
- paid social campaigns;
- games or applications;
- commercial film or video;
- music releases generating commercial revenue; or
- other revenue-generating uses.
Where monetization is intended, obtain a license that expressly permits the intended use.
8. Commercial Licenses
Globe King Records may offer commercial, non-exclusive or other expanded licenses.
A commercial license may grant additional rights such as:
- commercial release;
- monetization;
- streaming distribution;
- commercial video use;
- client work;
- advertising;
- broader distribution; or
- other specifically negotiated uses.
The exact rights are determined by the written license or agreement provided for the transaction.
Do not assume that a commercial license includes every possible commercial use.
9. Exclusive Licenses
An exclusive license is available only where Globe King Records expressly grants exclusive rights in a separate written agreement.
An exclusive license may contain specific provisions regarding:
- territory;
- duration;
- permitted uses;
- distribution limits;
- previous customers;
- existing licenses;
- Content ID;
- monetization;
- credits;
- derivative works;
- ownership;
- termination; and
- other negotiated conditions.
The specific written agreement controls the scope of the exclusive rights granted.
10. Copyright Ownership and Assignments
Globe King Records retains copyright ownership unless a separate written agreement expressly transfers or assigns copyright ownership.
A statement such as “exclusive,” “exclusive rights” or “exclusive license” does not by itself necessarily mean that copyright ownership has been transferred.
If copyright ownership is intended to transfer, the applicable written agreement must expressly state the transfer or assignment and its scope.
11. Commissioned Music and Custom Work
Custom beats, jingles, commissioned music, production services and other specially created works may be governed by a separate written agreement.
That agreement may specify:
- ownership;
- licenses;
- permitted uses;
- exclusivity;
- territory;
- duration;
- revisions;
- payment;
- credits;
- delivery;
- commercial rights;
- distribution;
- Content ID; and
- other conditions.
Where a separate written agreement exists, it governs the commissioned work to the extent it conflicts with these general terms.
12. Third-Party Elements
Some musical products may contain or incorporate elements that Globe King Records does not exclusively own.
These may include:
- licensed sounds;
- software-generated elements;
- royalty-free materials;
- loops;
- samples;
- sound libraries;
- performances;
- third-party recordings; or
- other materials obtained under third-party terms.
Globe King Records will grant only the rights that it owns or has authority to grant.
A customer may not represent third-party material as their own property or use it beyond the applicable license.
13. Samples and Sample Packs
Unless expressly stated otherwise, purchasing a beat does not grant the right to extract, isolate, resell, redistribute or repurpose individual samples, loops, stems or sound elements contained within the beat.
Those elements may be subject to separate ownership or licensing restrictions.
Future sample packs offered by Globe King Records may have separate licensing terms.
14. Derivative Works and Modifications
Customers may make reasonable creative modifications to a beat as permitted by the applicable license.
Unless a separate agreement permits otherwise, customers may not substantially transform, redistribute or commercially exploit the underlying beat outside the rights granted by the applicable license.
A substantial remix, rework, adaptation or creation intended to exploit the underlying beat independently may require separate written authorization.
15. Content ID
Basic beat purchases do not automatically include the right to register the beat or a recording containing the beat with YouTube Content ID or a similar automated rights-management system.
Where Content ID rights are available, they must be expressly included in the applicable commercial or other written agreement.
A customer must not use automated rights-management systems in a manner that creates false copyright claims against Globe King Records, other customers, collaborators or legitimate users of the same material.
16. Credits
For basic purchases, giving credit to Globe King Records or Globe Made It is appreciated but is not generally mandatory unless the applicable product terms state otherwise.
Commercial, exclusive or commissioned agreements may contain specific credit requirements.
Where credit is required by a written agreement, the customer must follow the format specified in that agreement.
17. No Automatic Transfer of Rights
Purchasing a digital product does not automatically transfer:
- copyright;
- publishing rights;
- master rights;
- synchronization rights;
- performance rights;
- mechanical rights;
- neighboring rights;
- Content ID rights;
- trademark rights;
- ownership of third-party material; or
- any other right not expressly granted.
The rights provided are limited to those expressly included in the applicable purchase or written agreement.
18. Personal Use
Where a product is sold for personal use, the purchaser may use the product only within the personal-use rights specified by the applicable product terms.
Personal use does not include use for a client, employer, business, brand, paid campaign or other commercial purpose unless expressly authorized.
19. Commercial Client Work
If you intend to use a Globe Made It beat for a client, customer, employer, brand or other commercial party, you are responsible for obtaining the appropriate license before using the beat.
A personal purchase cannot be converted into a commercial license simply because the customer later decides to use the beat commercially.
20. Transfer of Purchased Rights
Unless expressly permitted by a written agreement, you may not transfer, resell, sublicense or assign your purchased license to another person or business.
This includes transferring a beat license to:
- another artist;
- a record label;
- a production company;
- a client;
- a business partner; or
- another organization.
Where a transfer is necessary, contact Globe King Records before transferring or assigning any rights.
21. Multiple Artists and Projects
Unless the applicable license expressly permits it, a basic license is intended for the purchaser's own permitted use and does not automatically authorize unrestricted use by multiple artists, companies or commercial projects.
If multiple artists, businesses, clients or productions will use the beat, obtain the appropriate expanded license.
22. Resale and Redistribution
You may not resell, redistribute, lease, sublicense, upload or otherwise make the beat available as a standalone musical product.
You may not use a Globe Made It beat as the primary asset of a competing beat marketplace, music library, sample library or similar service.
23. Copyright Registration
A purchaser may not register the underlying Globe Made It beat itself as though the purchaser were its copyright owner.
A customer may register their own original contributions to a finished work where legally appropriate, but such registration does not transfer ownership of Globe King Records' underlying material.
Customers remain responsible for ensuring that any registration accurately identifies ownership and rights.
24. Rights Clearance
The customer is responsible for confirming that their intended use falls within the rights granted by the applicable license.
If a project contains additional music, samples, performances, lyrics, recordings, images or other copyrighted material, the customer is responsible for obtaining any additional permissions required for those materials.
Purchasing a Globe Made It beat does not clear unrelated third-party material.
25. Existing Licenses
Where a beat has previously been licensed on a non-exclusive basis, those existing licenses may remain valid unless the applicable exclusive agreement expressly provides otherwise and such termination is legally effective.
An exclusive purchaser acknowledges that previously granted rights may affect the practical scope of exclusivity.
Specific existing-license information may be addressed in an applicable exclusive agreement.
26. Product Removal or Rights Problems
Globe King Records may remove or restrict a beat where reasonably necessary because of:
- copyright concerns;
- third-party claims;
- licensing restrictions;
- technical problems;
- legal requirements;
- security concerns; or
- other circumstances affecting the lawful availability of the product.
If a purchased product is affected by a rights issue, Globe King Records will assess the circumstances and may provide an appropriate remedy where required.
27. No Guarantee of Third-Party Compatibility
Globe King Records does not guarantee that a digital product will be compatible with every:
- digital audio workstation;
- music-production application;
- hardware device;
- operating system;
- streaming platform;
- distribution service;
- content-management system; or
- third-party service.
Technical specifications and compatibility may change over time.
28. No Guarantee of Commercial Success
Purchasing or licensing a beat does not guarantee:
- streams;
- views;
- followers;
- sales;
- chart placement;
- monetization;
- playlist placement;
- viral performance;
- licensing opportunities; or
- commercial success.
The customer is responsible for their own creative, promotional and business decisions.
29. Violation of License Terms
If Globe King Records reasonably believes that a customer is using a beat outside the rights granted, it may take measures permitted by law, including:
- contacting the customer;
- requesting that unauthorized use stop;
- restricting download access;
- suspending future purchases;
- requiring additional licensing;
- removing or disabling affected material where within its control;
- preserving relevant evidence;
- reporting suspected infringement or fraud; and
- pursuing available legal remedies.
Where appropriate, Globe King Records may first provide an opportunity to correct an inadvertent licensing issue.
30. No Expansion by Implication
No right is granted by implication.
If a particular use is not expressly authorized by the applicable product terms or written agreement, the customer should contact Globe King Records before using the beat for that purpose.
31. Separate Written Agreements
Globe King Records may enter into separate agreements for:
- commercial licenses;
- exclusive licenses;
- commissioned works;
- custom jingles;
- production services;
- synchronization;
- publishing;
- assignments;
- buyouts; or
- other specialized rights.
A separate written agreement may supplement, replace or override these general terms for the specific transaction.
32. Interpretation
These terms are intended to clearly identify the rights granted to customers while protecting Globe King Records' ownership and third-party rights.
Nothing in these terms is intended to limit a right that cannot legally be limited or excluded.
Where mandatory law provides a greater consumer or copyright protection, that law prevails.
